HabitXP Terms of Use

1. About HabitXP

HabitXP is a habit-tracking application designed to help you create habits, track completion, build consistency, and visualize your progress.

HabitXP provides a free version of the app and may also offer optional Premium features through in-app purchases or subscriptions.

HabitXP does not require you to create an account or sign in to use the app.

2. Use of the App

You may use HabitXP for your personal, lawful purposes.

You agree not to:

• Use HabitXP for unlawful purposes;
• Attempt to interfere with, damage, or gain unauthorized access to the app or its underlying systems;
• Reverse engineer, modify, or distribute the app except where applicable law expressly permits it;
• Misuse payment, subscription, restoration, or promotional mechanisms;
• Use automated methods to abuse or overload services associated with HabitXP.

You are responsible for how you use the app and for maintaining the security of your own device.

3. Local Data and Offline Use

HabitXP is designed to work offline.

Much of the information you create in the app, including habits, completions, reminders, notes, preferences, and related progress information, is stored locally on your device.

Because this information is stored locally, you are responsible for maintaining access to your device and, where provided, making appropriate backups or exports of your data.

HabitXP does not guarantee that locally stored data will always be recoverable following events such as device loss, device damage, operating-system failure, accidental deletion, application removal, or other circumstances outside our reasonable control.

Where HabitXP provides a backup or export feature, you are responsible for deciding when to create and retain a backup.

4. Premium Features

HabitXP may offer optional Premium features.

Premium access may be provided through:

• Recurring subscriptions, such as monthly or yearly plans; and
• One-time purchases, such as a lifetime Premium purchase, where available.

The specific Premium products, prices, billing periods, and available features shown to you at the time of purchase apply to your purchase.

The free version of HabitXP remains available without purchasing a Premium plan.

5. Subscriptions and Automatic Renewal

Where a Premium product is offered as a subscription, the subscription automatically renews unless canceled before the end of the applicable billing period, subject to the terms of the relevant app store.

The applicable price and billing period will be displayed before you confirm your purchase.

For purchases made through Google Play, subscriptions are managed through your Google Play account and are subject to Google Play's applicable terms and policies.

For purchases made through the Apple App Store, subscriptions are managed through your Apple account and are subject to Apple's applicable terms and policies.

You can manage or cancel subscriptions through the applicable app-store account settings.

Canceling a subscription generally prevents future renewal but does not necessarily end access immediately; Premium access normally remains available until the end of the period for which it was purchased, subject to the applicable store's rules and the entitlement status of the purchase.

Google Play requires subscription offers to clearly disclose price, billing frequency, automatic renewal, and other material terms, and Apple similarly requires subscription information and access to Terms and Privacy Policy in the app.

6. Payments and Third-Party Payment Services

Payments for digital Premium products are processed through the applicable app store, such as Google Play or the Apple App Store.

HabitXP does not directly process or store your payment card details.

HabitXP uses RevenueCat to help manage in-app purchases, subscriptions, and Premium entitlement status. RevenueCat's services are subject to RevenueCat's own terms and privacy practices.

Google Play purchases are also subject to Google's applicable terms and policies. Apple purchases are subject to Apple's applicable terms and policies.

7. Purchases, Restores, Refunds, and Entitlements

Premium access is determined according to the applicable purchase and entitlement information provided by the relevant app store and supporting purchase-management services.

If you reinstall HabitXP, change devices, or otherwise need to recover a previous purchase, HabitXP may provide a Restore Purchases feature where supported.

Restoration of purchases is subject to the applicable app store account, purchase records, RevenueCat's purchase-management systems, and their respective policies.

Refunds, cancellations, chargebacks, billing issues, and other payment disputes are handled according to the applicable app-store policies and procedures.

HabitXP does not guarantee that every purchase will be restorable in every circumstance, particularly where a purchase cannot be verified by the relevant store or service.

8. Changes to Premium Features

We may add, remove, modify, or improve features of HabitXP over time.

Premium features may also change as the app develops. We will not intentionally misrepresent the features included with a Premium purchase.

Changes to a subscription offering will be handled in accordance with applicable platform requirements and consumer-protection laws.

9. Intellectual Property

HabitXP, including its software, branding, name, logo, visual design, interface, original graphics, text, and other original content, is owned by or licensed to HabitXP and is protected by applicable intellectual-property laws.

These Terms do not grant you ownership of HabitXP or any of its intellectual property.

You may use the app under these Terms for its intended purpose, but you may not reproduce, redistribute, sell, or commercially exploit HabitXP or its proprietary materials without appropriate authorization.

10. User-Generated Content and Data

You retain ownership of the personal content you create and store in HabitXP, subject to any rights necessary for the app to provide its functionality.

Because HabitXP is designed around local storage and does not require an account, your habit information is primarily maintained on your own device rather than as an online user profile operated by us.

You are responsible for the accuracy and appropriateness of any information you enter into the app.

12. Availability and Updates

We aim to keep HabitXP reliable and available, but we do not guarantee that the app will always operate without interruption, errors, or delays.

The app may occasionally be unavailable because of maintenance, operating-system changes, app-store requirements, technical problems, or circumstances beyond our reasonable control.

We may release updates, bug fixes, security improvements, or other changes to HabitXP from time to time. Some features may require an updated version of the app.

13. Third-Party Platforms and Services

HabitXP may depend on third-party platforms and services, including:

• Apple App Store;
• Google Play;
• RevenueCat; and
• Other infrastructure or services necessary to distribute and operate the app.

Your use of those platforms may also be governed by their respective terms, agreements, and policies. HabitXP is not responsible for the independent policies, availability, or operation of third-party services.

14. Disclaimer of Warranties

To the extent permitted by applicable law, HabitXP is provided on an “as is” and “as available” basis.

We do not guarantee that HabitXP will:

• Always be available;
• Always be free from errors or interruptions;
• Meet every individual requirement;
• Preserve locally stored data under every circumstance; or
• Produce any particular personal, health, productivity, or habit-related result.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited under applicable law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, HabitXP will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use HabitXP.

This includes, where legally permitted, loss of data resulting from circumstances outside our reasonable control.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

16. Termination

You may stop using HabitXP at any time by uninstalling the app or otherwise ceasing to use it.

We may restrict or terminate access to HabitXP where reasonably necessary, including in response to misuse, fraud, security threats, legal requirements, or material violations of these Terms.

Termination does not affect rights or obligations that by their nature should continue after termination.

17. Changes to These Terms

We may update these Terms from time to time to reflect changes to HabitXP, applicable law, or our services.

When we make material changes, we may update the “Last updated” date and, where appropriate, provide additional notice.

Your continued use of HabitXP after updated Terms become effective means you accept the revised Terms, to the extent permitted by applicable law.

18. Governing Law

These Terms are governed by applicable laws, without regard to conflict-of-law principles, except where mandatory consumer protection regulations require otherwise.

Any disputes will be handled by the courts or dispute-resolution mechanisms having appropriate jurisdiction, subject to applicable consumer-protection laws.
